Statutory guidance

'Inclusion is a process by which schools, LEAs and others developing their cultures, policies and practices to include all pupils'. (Inclusive schooling 2001)

Maintained schools and LEAs must have regard to the guidance.

Main points:

examples of the steps settings and LEAs should consider taking to ensure that a child's inclusion is not compatible with the efficient education of other children
instances when it may not always be possible to include specific children in mainstream settings
a child who has special educational needs and a statement must be educated in a mainstream school/setting unless that would be incompatible with the wishes of the child's parents; or the provision of efficient education of other children

Inclusion may not be possible for 'pupils whose behaviour systematically, persistently and significantly threatens the safety and impedes the learning of others'*.
*Others refers to the children with whom the child who has a statement will directly come into contact with on a regular day-to-day basis.
