English fluency duty: Guidance for schools

On 21 November 2016, part 7 of the Immigration Act 2016 (the Act) came into force, requiring public authorities to ensure that anyone who works for them in a customer-facing role (which for school purposes includes pupils) speaks fluent English.

The government has issued a statutory code of practice on the English language requirements for public sector employees (GOV.UK)

Guidance for schools

Guidance for Ealing schools on implementing the duty has been produced in consultation with headteachers and trade unions - see downloads section below.

The guidance covers:

  • Which roles in the school are covered by the duty
  • How recruitment practices will change to ensure that newly recruited staff occupying relevant roles are properly assessed
  • How schools can assess those within the existing workforce who occupy a role which is covered by the duty and how to communicate this new requirement to existing staff.
